TERMS OF SERVICES IN TRANSLATION AND INTERPRETING PROVIDED BY JUST IN TRANSLATIONS (“TERMS”)

I. DEFINITIONS

  1. “Translator” or “Sworn translator” or “Interpreter” in this Terms means Justyna Zdunek-Partyka trading as Just In Translations (registered in the UK) and providing translation and interpreting services.
  2. “Translation/Interpreting Service” – translation or interpreting services performed each time in a written or oral form from Polish to a foreign language and from a foreign language to Polish and between two foreign languages.
  3. “Order” – placement of translation or interpreting work with the Translator by the Client.
  4. “Client” – a company, institution or an individual being a receiver of Translator’s services.
  5. “Source text” – a text to be translated delivered to the Translator as hard copy, electronically or in any other form.
  6. “Target text” – a text translated by the Translator and delivered to the Client.
  7. “Ordinary translation” – a translation which is not signed and sealed by a sworn translator, produced in paper or electronic form.
  8. “Sworn translation” – a translation bearing a sign and seal of a sworn translator, produced in paper form.
  9. “Specialised translation” – a translation containing expert terminology.
  10. “Source word” – a basis for price calculation; the words in a document to be translated are counted, and that figure is multiplied by the agreed-upon per-word fee to come up with the total amount that will be payable for the translation.

II. GENERAL PROVISIONS

  1. These Terms specify the conditions of the cooperation between the Translator and the Clients. Placing an Order by the Client constitutes acceptance of these Terms.
  2. The Translator undertakes to provide the services with due diligence and in accordance with the rules of the trade, and in compliance with the standards on professional ethics.
  3. Any translation or interpreting services are performed based on a written order delivered electronically to the address: info@just-in-translations.co.uk (or any other address previously agreed upon with the Translator). The assignment is deemed accepted upon sending of a confirmation email by the Translator.
  4. The Translator undertakes to keep confidential all the information received from the Client. This does not apply to information and documents which are publically available or legally received from a third party.
  5. Upon payment of a translation / interpretation fee by the Client (acceptance of Work), the Translator transfers to the Client proprietary copyrights to the results of the Translation Services performed based on these Terms constituting works as defined by the Act on Copyright and Related Rights of 4 February 1994 (Dz. U. – Polish Journal of Laws, item 666, as amended), without any time and place restrictions.

III. TRANSLATION SERVICES

  1. Translation services are performed in the following language pairs: English – Polish (ordinary and sworn translations) and Russian – Polish (ordinary translations).
  2. Generally, translation services are performed personally by the Translator. However, in the case of large-volume projects or tight deadlines, the Translator reserves the right to subcontract translation work to a competent third party – such translation is then revised by the Translator.
  3. Translation price includes internal proofreading (except for express translations where there is no time for proofreading). Proofreading by external verifier is subject to additional fee.
  4. In the case of express translations additional fee may be charged.
  5. In the case of sworn translations, the cost of the certification of a translation performed by somebody else amounts to 50% of the translations price, and the cost of an additional copy of the translation amounts to 30% of the translation price.
  6. The order may be cancelled only in writing (by email). Where a confirmed translation is cancelled, the Client shall be charged with the costs of translation performed up to the moment of receiving cancellation information by the Translator.

IV. INTERPRETING SERVICES

  1. Generally, the cost of interpreting assignments is calculated based on 4-hour blocs. Per hour arrangements are also possible based on particular circumstances. The price may be increased by the Translator’s transportation and accommodation costs.
  2. Where the Client cancels an interpreting assignment less than 48 hours (excluding Saturdays, Sundays and bank holidays) before the planned commencement of work, the Client shall be charged with the sum amounting to 50% of the assignment price.

V. FINAL PROVISIONS

  1. Placing an order under the terms set out herein entails the obligation to pay for the service provided. Payment shall be made upon receipt of a relevant invoice.
  2. Payment shall be transferred to the bank account set out in the invoice within 14 days from the date it is issued.
  3. The Translator is liable towards the Client for any damages arising in connection with the service provided up to a maximum amount equal to the remuneration for a given assignment.
  4. The Translator undertakes to review a complaint made in respect of improper performance of translation services. Improper performance of translation services means a translation containing significant discrepancies in relation to the original or unacceptable number of errors (stylistic, spelling and grammatical), calques or containing omissions in the texts. If the Translator considers the complain to be a justified one, the Translator undertakes to rectify the defects.
  5. Minor error (such as typos) cannot constitute a basis for complaint in express translations.
  6. The Translator is not liable for any errors as to the merits of the text resulting from errors in the original document.
  7. The Translator is not liable for delays and defects resulting from reasons beyond the control of the Translator, such as force majeure events, computer equipment or Internet and telephone connection failures or power cuts.
  8. In matters not regulated herein the provisions of the Polish Civil Code and other applicable provisions shall apply.
  9. In case of any disputes between the Translator and the Client, the Translator will make every effort to ensure such dispute is resolved amicably. If this turns out impossible, a competent court for settling such matters is that having jurisdiction over the seat of Just In Translations in Poland.
  10. These Terms become effective as of 1st September 2017.
